Paper Hearing

A paper hearing involves each party submitting its documents to the Judge (see note below) who will then consider the documents together with the relevant law and provide a written judgment on both the issues in dispute and costs (if necessary).

A paper hearing may either be determinative (will bind the parties) or indicator (will give the parties the legal experts view on the case which can then be used to assist in reaching a settlement.

Note: Our panel of legal experts are all specialist solicitors or barristers who have been qualified for at least 10 years. The word “judge” is used to describe the lawyer deciding the case. Although a number of our legal experts are also appointed to sit as a judge by the Courts, he or she will be acting independently from this role.
